Please read this Privacy Policy carefully. By accessing or using the Services, you acknowledge that you have read and understand the practices described in this Privacy Policy.

How We Use Personal Information
Depending on how you interact with the Services, we may use personal information for the following purposes:
Providing and Improving the Services
We use personal information to operate and provide the Services, process payments, administer customer accounts, process and fulfill orders, provide shipping and tracking information, communicate about transactions, process returns and refunds, remember preferences, provide customer support, maintain business records, troubleshoot technical problems, and improve the functionality and customer experience of the Services.
Membership Administration
We use personal information to create and administer memberships; provide free trials and membership benefits; apply eligible discounts and shipping benefits; process membership payments and renewals; send transactional notifications and renewal reminders; provide access to the Membership Portal; manage cancellations, pauses, payment failures, and refunds; and maintain membership and billing records.
Campaigns, Petitions, Surveys, and Quizzes
We use campaign, petition, survey, and quiz information to record and administer participation, process submitted responses, personalize the campaign experience, determine promotional eligibility, provide requested products or benefits, communicate about participation, prevent duplicate or abusive entries, measure campaign performance, and improve future campaigns.
Participation in a petition, campaign, survey, quiz, purchase, or membership does not by itself constitute consent to receive marketing communications where separate consent is required.
We do not sell petition signatures or the content of individual petition or quiz responses as standalone marketing lists. We may use campaign participation, referral information, and aggregated or de-identified results for business analytics, campaign measurement, and promotional planning.
Marketing and Advertising
Where permitted by applicable law or with your consent when required, we may use personal information to send marketing and promotional emails, personalize the Services, measure advertising performance, understand customer interests, and display or measure advertisements through third-party platforms.
This may include using contact information, advertising identifiers, referral information, website activity, campaign participation, product interests, purchases, and membership activity.
You may unsubscribe from promotional emails at any time by using the unsubscribe link included in the email. Unsubscribing from marketing does not prevent us from sending non-promotional communications concerning your orders, account, membership, billing, security, cancellations, refunds, or other requested services.
Security, Fraud Prevention, and Promotional Integrity
We use personal information to authenticate users; maintain payment and account security; prevent, identify, investigate, or address suspected fraud, unlawful activity, security incidents, payment abuse, duplicate promotional participation, unauthorized transactions, or violations of our policies; protect customers and the public; and preserve the security and integrity of the Services.
Communications and Customer Support
We use personal information to respond to questions, complaints, privacy requests, cancellation requests, refund requests, order problems, membership inquiries, and other communications, and to maintain our customer and business relationships.
Legal and Business Purposes
We may use personal information to comply with applicable laws, tax and accounting obligations, court orders, subpoenas, regulatory requirements, payment-network rules, and valid government or law-enforcement requests; establish, exercise, or defend legal claims; enforce our terms and policies; conduct audits; complete corporate transactions; and maintain records reasonably necessary to operate and protect our business.
How We Disclose Personal Information
We may disclose personal information when reasonably necessary for the purposes described in this Privacy Policy, including:
-
To Shopify, which hosts the Services, supports checkout and customer accounts, processes transactions, provides fraud-prevention and analytics services, and provides enhanced ecommerce, personalization, advertising, and business services.
-
To payment providers and financial institutions that authorize, process, settle, refund, or investigate payments and payment disputes.
-
To Appstle and other membership providers that administer membership enrollment, benefits, billing schedules, renewals, notifications, customer portals, cancellations, payment failures, and membership records.
-
To ConvertFlow and other campaign or form providers that host or process campaign pages, petition forms, quizzes, surveys, lead information, and submitted responses.
-
To production, fulfillment, shipping, and logistics providers that manufacture, fulfill, ship, deliver, track, return, or resolve problems concerning customer orders.
-
To Meta and other advertising, analytics, and social-media providers that help deliver advertisements, measure campaign performance, attribute conversions, understand website activity, and provide advertising or analytics services.
-
To technology and business-service providers supporting website hosting, cloud storage, email delivery, customer support, fraud prevention, cybersecurity, accounting, legal services, data analysis, and business administration.
-
When you direct or authorize the disclosure, including when you request shipment, use a third-party login or social-media feature, or otherwise ask us to interact with another party.
-
In connection with a business transaction, including a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or transfer of all or part of the business.
-
For legal and protective purposes, including to comply with applicable law, respond to valid legal process, enforce our terms or policies, prevent fraud or security threats, protect the Services, or protect the rights, property, and safety of American Power, our customers, or others.
Service providers may receive only the information reasonably necessary to perform their services, subject to their agreements, applicable law, and their own privacy obligations.
Sale, Sharing, and Targeted Advertising
We do not sell personal information for monetary compensation.
We may disclose identifiers, contact information, device information, internet or network activity, transaction information, advertising information, and related data to Shopify, Meta, and other advertising or analytics partners in ways that may be considered “selling,” “sharing,” or targeted advertising under certain United States privacy laws, even though no money is exchanged for the personal information.
Depending on where you reside, you may opt out of these activities through our Data Sharing Opt-Out page or through a recognized Global Privacy Control signal.
Relationship With Shopify
The Services are hosted by Shopify. Shopify collects and processes personal information concerning your access to and use of the Services to provide, secure, personalize, and improve Shopify services and the Services offered by American Power.
Information submitted through the Services is transmitted to Shopify and may be shared with Shopify service providers and other third parties located in countries other than where you reside.
We may use Shopify Network Intelligence and related enhanced features. When enabled, these services may incorporate information from your interactions with American Power, other Shopify merchants, and Shopify to improve fraud prevention, ecommerce functionality, personalization, advertising, analytics, and store performance.
In connection with certain enhanced services, Shopify is responsible for its own processing of personal information, including responding to requests relating to Shopify’s use of personal information for those purposes.
You can learn more by reviewing the Shopify Consumer Privacy Policy and may exercise certain rights relating to Shopify’s processing through the Shopify Privacy Portal.
Cookies and Similar Technologies
We and our service providers use cookies, pixels, tags, local storage, server logs, software development kits, and similar technologies to operate and secure the Services, remember preferences, maintain shopping carts and customer sessions, understand website usage, measure campaign performance, prevent fraud, personalize content, and provide or measure advertising.
Some cookies and technologies are necessary for the Services to function. Others support preferences, analytics, personalization, or advertising and may be controlled through our cookie banner, cookie-preference settings, or Data Sharing Opt-Out page where those controls are available or required.
Third parties, including Shopify, Meta, and other analytics or advertising providers, may collect information through these technologies concerning your device and online activity over time and across different websites or services.
Where required by applicable law, we will obtain consent before using nonessential cookies or similar technologies. You may adjust available cookie preferences through the cookie controls provided on the Services. Browser settings may also allow you to block or delete cookies, although doing so may prevent certain portions of the Services from functioning properly.
We recognize Global Privacy Control signals as requests to opt out of sale, sharing, or targeted advertising where required by applicable law. Other than Global Privacy Control and other signals we are legally required to recognize, we do not respond to browser “Do Not Track” signals because there is no uniform industry standard governing those signals.
Third-Party Websites and Services
The Services may contain links to websites, applications, social-media platforms, or other services operated by third parties. We do not control and are not responsible for the privacy, security, accuracy, or practices of unaffiliated third-party services.
If you follow a third-party link or provide information directly to another service, you should review that service’s privacy policy and terms. The inclusion of a link does not necessarily constitute an endorsement of the third party or its content.
Information you publish in public or semi-public areas, including social-media platforms or public comments, may be viewed and used by other users or third parties.
Security of Personal Information
We use reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, destruction, loss, alteration, disclosure, or misuse.
However, no security system, online service, or method of electronic transmission is completely secure. We cannot guarantee absolute security. Please do not send payment-card numbers, account passwords, government identification numbers, or other highly sensitive information through ordinary email or unsecured forms.
Customers are responsible for maintaining the confidentiality of their account-access methods and for promptly notifying us of suspected unauthorized account activity.
Retention of Personal Information
We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, administer accounts and memberships, process and document transactions, provide customer support, maintain tax and accounting records, comply with legal and payment-network obligations, prevent fraud and promotional abuse, resolve disputes, and enforce our agreements.
Retention periods vary depending on the type of information, the nature of our relationship with you, applicable legal requirements, contractual obligations, and whether the information is necessary to establish, exercise, or defend legal claims.
When personal information is no longer reasonably required, we may delete, anonymize, or de-identify it, subject to applicable law and technical limitations concerning backups and archival systems.
